Open Meeting Violation for Previous Sturbridge BOS
As stated by Hal White, a letter was faxed to him on June 18th by the District Attorney’s office regarding the Open Meeting Law Violation incurred by the Sturbridge BOS under his chairmanship earlier this year. This violation was with respect to the 2007 Performance Appraisal for the Town Administrator. Mr. White asked “what could they do about this since it was in direct opposition to the legal advice given to him by Kopelman and Page?” Jim Malloy stated there was nothing that could be done except to release the performance evaluation as he had already done at the request of the Worcester Telegram & Gazette. The violation appears to be how the performance evaluation was conducted and not released as part of the public record. As reported here on April 10th, Jim Malloy did not agree with the results of the performance appraisal as they were much different than the results of the past 13 years. Former selectman Arnold Wilson stated the same at the Sturbridge BOS meeting on April 7th when the results of the performance evaluation were delivered.
